Who are we?
The Observatorio Iberoamericano del Derecho de Autor (Ibero-American Observatory of Intellectual Property Rights - ODAI) aims to monitor the legal reality and the economic  impacts  regarding intellectual property rights  and related rights in Ibero-America, with the purpose of supporting the formulation, implementation, and evaluation of public policies focused on the protection of these rights.  

ODAI is the meeting point of the public and private sector for promoting the strengthening of Ibero- American cultural goods and services.  It promotes spaces for deliberation and coordination between all the actors from the industries protected by copyright (IPC) and works for the consolidation of the Observation Network on this matter.

Our activities began in 2008, with the initiative of the Regional Center for the Promotion of Books in Latin America, the Caribbean, Spain, and Portugal (CERLALC) and of the Authors Foundation of the General Society of Authors and Editors (SGAE).  In the Experts Meeting to Implement Public Policies for Intellectual Property Rights, held in October 2006 in Santiago de Chile, a Diagnosis of Intellectual Property Rights in Latin America was presented.    Upon learning the conclusions of the Diagnosis, the two above mentioned institutions followed the regional governments’ recommendations and committed to the consolidation of an Ibero- American observational entity.


What is the purpose of having an Observatory of Intellectual Property Rights?

To support the generation of statistics and promote research that accounts for the economic impact of the cultural goods and services protected by intellectual property rights.

To reflect upon sensitive topics regarding intellectual property rights, such as the challenges of the digital environment, the collective management of rights, and remuneration for private copies, among others.


 

Who is invited to take part in the Observatory?

ODAI is a space that is open to the entire creative community. Nonetheless, given some sectors’ paramount interest in intellectual property rights and related rights, the ODAI will have special guests including various governments of the region, observation authorities, academia, regional and multilateral entities, non-governmental organizations, strategic public-private sector anti-piracy alliances, and of course, users of works and contents protected by intellectual property rights  and related rights.

Promote the participation of all stakeholders of the sector interested in the processes of formulation, implementation, and evaluation of public policies.Create a platform for copyright offices and/or registers, including the Central American countries, Mexico, Panama, Cuba, and the Dominican Republic.
Establish strategic alliances with universities and study centers for research on topics of interest of the region.
Create a platform for copyright societies to share experiences and viewpoints.
Participate in the Cultural Industries group promoted by the Chamber of Commerce of Bogotá.
Analyze the studies made in the region regarding the impact of copyright and related rights on national economies.
Organize the Conference of the Society for Economic Research on Copyright Issues, SERC, to be held in 2010 in the city of Cartagena, Colombia.
Produce comparative studies that allow Ibero- American governments to understand the “state of the art” of IPC’s.
Carry out regional diagnostics regarding the legislative and institutional reality of Industries Protected by Copyright, IPC.
Follow up on the research conducted by the Author’s Foundation of SGAE, regarding the entities in charge of internationalizing culture.
Follow up on and analyze the main developments in jurisprudence occurring in the region.
Publish a monthly interview in ODAI Reporta about progress in legislation, jurisprudence, and regulation on intellectual property rights and related rights.
Carry out economic-legal analysis on Compensation for Private Copy, CPC, so as to offer a basis for decisions for the sectors interested in the legislative initiative on compensatory fees.
Follow up on the bilateral, regional, and multilateral negotiations conducted on this matter, and their effects upon culture.
Carry out a study on the existing provisions regarding Limitations on the Responsibility of Internet Service Providers, resulting from the free trade agreement with the United States.
Observe the new negotiations being undertaken in the region.
Analyze the outcome of the FTA entered into by the countries of the region.
Examine the impacts of technological changes on intellectual property rights, as well as the proposals that aim to maintain a balance between authorship rights and the right to access to culture in the new environment.
Hold the First International Biennial Seminar on cultural diversity, cultural industries, and the importance of the diversity of these industries in the development of the region. The seminar will take place by the end of 2009 in Madrid.
Publish a simple manual addressed to businesspersons about contents protected by copyright through the Internet.
Monitor the initiatives, proposals, and outcomes of successful experiences that guarantee intellectual property rights.
Organize the first Meeting of National Anti-Piracy Alliances.
Create a web platform in order to connect all the experiences of the Anti-Piracy Alliances, and encourage the creation of such alliances where they still do not exist.
